1. The service
Nuby uses artificial intelligence to generate carousels and short videos (reels) from the pages you provide and, if you connect your social accounts, publishes or schedules them on your behalf when you decide. By creating an account you accept these terms. The service is intended for professionals and businesses aged 18 or over.
2. Your account
You sign in with a code we send to your email or with your Google account. You are responsible for what is done with your account and for keeping access to your email secure.
3. Free trial
Each person can try Nuby once with one free campaign, with regeneration limits and without publishing to social networks (you can download the content). The trial is per email and is not renewed if you delete your account. If the trial campaign fails because of an error on our side, you can run it again.
4. Plans, prices and payments
- The paid plans (monthly or yearly), their limits and prices are shown on the pricing page. Prices include VAT.
- Payment is made in advance by card through Stripe and the subscription renews automatically at the end of each period until you cancel it.
- Each plan includes a number of campaigns per month (also on yearly plans, whose campaigns renew every month). A campaign is counted when it is created; deleting it does not give it back. If a campaign fails because of an error on our side, it is given back.
- If a payment fails, Stripe will retry it; while it is pending you cannot create new campaigns.
- We may change prices or plans with at least 30 days' notice; the change applies at your next renewal and you can cancel before it if you disagree.
- You get a receipt after each payment. If you need an invoice with your tax details, write to us.
5. Cancellation and refunds
You can cancel at any time from the billing section. Cancellation takes effect at the end of the period already paid, until which you keep your plan. We do not refund periods already started, except where the law requires it or the service could not be provided because of us.
Right of withdrawal (consumers): Nuby is digital content and a digital service that starts as soon as you subscribe. By subscribing you expressly request that the service starts immediately and acknowledge that, once started, you lose the 14-day right of withdrawal to the extent permitted by law.
6. Your content and your accounts
- You are responsible for holding the rights to the pages, images, logos, trademarks and data you use, and for reviewing the content before publishing it.
- The content you generate with Nuby is yours and you may use it commercially. You allow us to process and store it only to provide you with the service.
- By connecting a social account you authorise Nuby to publish on it only when you order or schedule it; you can revoke the authorisation at any time.
- On TikTok you choose for each post its privacy, the allowed interactions and whether it is commercial content; the content is labelled as AI-generated and publishing it means accepting TikTok's Music Usage Confirmation and, where applicable, its Branded Content Policy.
- By connecting YouTube you agree to the YouTube Terms of Service; reels are published as Shorts declared as AI-generated content.
7. Acceptable use
You may not use Nuby to create or publish content that is illegal, misleading or defamatory, that impersonates other people or brands, that infringes third-party rights or social network rules, nor to try to harm, overload or abuse the service (for example, creating accounts to repeat the free trial). We may suspend accounts that break these rules.
8. Artificial intelligence and liability
AI-generated content may contain errors or inaccuracies: review it before publishing. We are not responsible for the moderation decisions of social networks or for the commercial results of your posts. We do our best to keep the service available, but there may be interruptions for maintenance or for reasons beyond our control. To the extent permitted by law, our total liability is limited to what you have paid in the last 12 months.
9. Closing your account
You can close your account at any time by writing to us. We may close or suspend an account that breaks these terms, notifying you except in serious cases.
10. Changes and governing law
If we change these terms significantly we will tell you in advance. They are governed by Spanish law; if you are a consumer, the laws of your country of residence also protect you and you may go to the courts of your place of residence.
